Welcome to KhanWare^©! These Terms of Service ("Terms") govern your use of the KhanWare^© website (the "Site") and the services offered through it (the "Services"). By accessing or using the Site, you agree to be bound by these Terms.

1. Account Registration

You must create an account to purchase licenses. You agree to provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account.

2. License Purchases

KhanWare^© acts as a reseller of digital software license keys. We source keys from various providers. While we strive to ensure the validity of keys at the time of sale, we are not the original software creators and do not provide warranties regarding the software's functionality, compatibility, or fitness for a particular purpose.

ALL SALES ARE FINAL. Due to the digital nature of license keys, once a key is purchased and delivered via your account panel, it cannot be returned or refunded. Please ensure the software meets your system requirements and needs *before* purchasing.

3. Acceptable Use

You agree not to use the Site or Services for any unlawful purpose or in any way that could harm KhanWare^©, its users, or third parties. This includes, but is not limited to:

• Attempting to gain unauthorized access to our systems or user accounts.
• Using purchased licenses for illegal activities, including software piracy, cheating in games (e.g., using game modifications or exploits), or violating the software provider's end-user license agreement (EULA). KhanWare^© does not condone or support piracy, cheating, or any violation of third-party software terms. Use of our products for such purposes may result in account termination without refund.
• Distributing malware or engaging in phishing attempts.
• Overloading or disrupting the Site or its underlying infrastructure.

4. Support and Compensation

KhanWare^© provides support for issues directly related to the delivery and initial validity of the license key purchased through our Site. We do not provide technical support for the underlying software itself. If you encounter technical issues with the software, please consult the software developer's official support channels.

In the event a purchased key is proven invalid *at the time of delivery* or you experience significant downtime due to a verifiable issue originating from KhanWare^©'s service affecting your key's usability, we may, at our sole discretion, offer compensation in the form of extending the duration of the affected license key. Monetary refunds are not provided as per our "All Sales Final" policy.

5. Intellectual Property

The KhanWare^© name, logo, and website design are the property of KhanWare^©. The software licenses sold belong to their respective creators and are subject to their own EULAs.

6. Disclaimers and Limitation of Liability

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. KHANWARE^© DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL KHANWARE^©, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

7. Indemnification

You agree to defend, indemnify and hold harmless KhanWare^© and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

8. Dispute Resolution

We encourage you to contact our support team first if you have any issues or disputes. Most issues can be resolved quickly through our Discord server or by emailing khan@khanware.xyz. Any legal disputes arising out of these Terms will be resolved in accordance with the Governing Law section.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

Privacy Policy

This Privacy Policy describes how KhanWare^© ("we," "us," or "our") collects, uses, and shares information about you when you use our Site and Services.

1. Information We Collect

• Account Information: When you register, we collect your email address. We use Firebase Authentication for secure management.
• Purchase Information: We store a record of the licenses you purchase (product ID, duration, generated key) associated with your account in our Firestore database.
• Payment Processing Information: Payment details (credit card numbers, crypto wallet addresses) are processed directly by our third-party payment processors (Square, Coinbase Commerce). KhanWare^© **does not directly collect or store** your full credit card number or private crypto keys. Processors may provide us with partial information (like card type, last 4 digits, transaction ID) for verification and support purposes.
• Usage Information: We may collect limited, anonymized information about how you interact with the Site through services like Cloudflare Analytics and Firebase performance monitoring to improve our service, understand usage patterns, and enhance security.
• Security Information: We use Cloudflare Turnstile and Firebase App Check to protect our Site and backend services from automated abuse (bots). This involves the collection of certain non-personally identifiable device, browser, and interaction data by Cloudflare as part of the verification process. This data is processed according to Cloudflare's privacy policy.

2. How We Use Information

• To provide, maintain, secure, and improve the Site and Services.
• To process transactions and fulfill orders (deliver license keys to your account).
• To manage your account and provide customer support related to your purchases or account issues.
• To communicate with you regarding your account, purchases, or important service updates.
• To prevent fraud, abuse, security incidents, and enforce our Terms of Service.
• To comply with legal obligations, resolve disputes, and enforce agreements.

3. How We Share Information

We do not sell your personal information. We limit sharing to the following necessary circumstances:

• With Payment Processors: We share necessary transaction details (like cart total, unique identifiers) with Square (for card payments) and Coinbase Commerce (for crypto payments) to facilitate secure payment processing. These providers handle your sensitive payment data according to their own privacy policies.
• With Service Providers: We utilize third-party services for essential operations. This includes:
  • Google Firebase: For backend infrastructure, including Authentication (user management), Firestore (database for storing keys and user info), Cloud Functions (backend logic), and App Check (security).
  • Cloudflare: For website hosting (Pages), security (DDoS protection, SSL), DNS management, and bot protection (Turnstile).
  These providers process data on our behalf based on our instructions and are subject to their own robust privacy and security policies.
• For Legal Reasons: We may disclose information if required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, property, or safety, or the rights, property, or safety of our users or others, investigate fraud, or respond to a valid government request.
• Business Transfers: In the event of a merger, acquisition, or asset sale, user information may be transferred as part of the transaction, subject to the receiving party adhering to promises made in this Privacy Policy.

4. Data Security

We implement and rely on industry-standard security measures provided by our partners (Firebase, Cloudflare, Square, Coinbase Commerce), including HTTPS encryption for data transmission and secure backend infrastructure. Access to sensitive user data within our systems is restricted. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

5. Data Retention

We retain your account information and purchase history for as long as your account is active and as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Anonymized usage data may be kept for longer periods for analytical purposes.

6. Your Choices & Rights

You can access and update your account email address through the Account Settings panel. You may request deletion of your account by contacting us; however, please note that we may need to retain certain information (like transaction records) for legal, accounting, or fraud prevention purposes.

7. Cookies and Similar Technologies

We primarily use essential browser storage mechanisms (like `sessionStorage` for Turnstile verification status) that are necessary for the core functionality of the site during a single session. We do not currently use persistent tracking cookies for advertising or extensive cross-site analytics.

8. Children's Privacy

Our Services are not directed to individuals under the age of 13 (or the relevant age of digital consent in your jurisdiction). We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected personal information from a child, we will take steps to delete it.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by posting the new policy on the Site, and the "Last Updated" date will be revised. We encourage you to review this policy periodically.
